In April 2024, the U.S. Department of Education issued the 2024 Title IX Final Rule on sex discrimination, including sex-based harassment (the “Final Rule”). The implementation day for the Final Rule is August 1, 2024, giving public schools and other covered entities just over 100 days to comply with the new requirements.
Of note, the Final Rule redefines sex-based harassment and broadens the scope of sex discrimination to include sex stereotyping, sex characteristics, pregnancy or related conditions, sexual orientation and gender identity. Significantly, as the Department of Education indicated in its press release, the Final Rule provides “appropriate discretion and flexibility to account for variations in school size, student populations and administrative structures.”
Shipman has set up this Title IX Resource Center in order to allow K-12 public schools to easily access information about Title IX, including links to upcoming training sessions and access to the latest information and guidance as it is released, all in one location.
Now Available:
The 2024 Title IX federal regulations require all Title IX coordinators, investigators, decisionmakers, and informal resolution facilitators to complete annual training. To assist K-12 school districts in meeting this requirement, Shipman and Goodwin is hosting virtual Title IX Training sessions for Title IX Coordinators, investigators, decisionmakers, and informal resolution facilitators. This 3-hour training is prepared for educators in these designated roles and provides comprehensive updates on the new Final Rule, practical guidance on compliance, and strategies for effective implementation, while fulfilling your requirements for training as set out in the Final Rule. Topics include:
- Detailed overview of the 2024 Title IX Final Rule
- Procedures for addressing allegations of sex discrimination, including sex-based harassment
- Best practices for conducting investigations and making decisions, including the meaning and application of the term “relevant” in relation to questions and evidence and the types of evidence that are impermissible
- Responsibilities of Title IX Coordinators, investigators, decisionmakers, and informal resolution facilitators
- How to serve impartially, including by avoiding prejudgment of the facts at issue, conflicts of interest and bias
- Rules and practices associated with the informal resolution process
The upcoming dates are listed above, and you may click to purchase the date of your choice, currently either August 6th or September 4th. Upon making your selection you will be redirected to a payment portal where you can choose to pay by credit card or pay offline to have an invoice sent to your school district. After completing the payment, you will be prompted to register for the webinar which will be hosted on your selected date. Please note: Only one training session per person is necessary to satisfy the federal training requirement.
Also Now Available: On Demand Training for All Staff
To comply with the Final Rule, all employees of K-12 public schools must now complete annual Title IX training. To assist school districts in meeting this requirement, Shipman has created an on-demand training video for Connecticut school districts to purchase. This one-hour training covers:
- The school district’s obligation to address sex discrimination, including sex-based harassment, in its programs and activities.
- The scope of conduct that constitutes sex discrimination, including sex-based harassment, under Title IX.
- Identifying and reporting incidents of sex discrimination, including sex-based harassment.
- Applicable notification and information requirements under Title IX that all employees must follow.
Please note: Purchase of the all-staff, on-demand module should be made at the district level, and each district that purchases will then receive a dedicated training link accessible to all of that district’s employees. If you are unsure whether or not your district has purchased the training module, please contact your Superintendent. School districts are responsible for independently tracking which staff members have completed the training, as Shipman does not issue certificates of completion.
