Media coverage of bullying and its devastating aftermath has certainly increased in recent years, as have anti-bullying initiatives of elected and appointed officials at all levels. With the resulting tide of increased statutory and regulatory requirements for school districts, has the potential for liability also increased? Are courts more likely now to find school districts liable for student-to-student bullying and harassment than they were before state anti-bullying statutes and federal guidance raised the stakes? Legislative enactments and court decisions that affect school district liability and analysis of current state law from a national perspective will be reviewed.
