Post-Kelo Reforms Tested in Eminent Domain Case

Obtained injunction from the Superior Court precluding the City of Middletown from taking our client’s commercial property by eminent domain for a parking lot. The judge criticized the City for not following the required post-Kelo protections for property owners, and faulted the City for its improper valuation in not using the income approach. The Court’s decision represents the first significant test of the State's post-Kelo reforms to the eminent domain laws.
