NBI: Disciplining Students with Behavioral Issues

Peter Maher is a co-speaker for a CLE course on disciplining students and the complicated legal dilemmas they can create for the school. Peter will present the portion titled, "Determining and Documenting Behavioral Issues" and also, "Discipline and Expulsion: A Practical Legal Guide." The program will also include information on the following:

  • Students whose misbehavior is a manifestation of their disabilities
  • How No Child Left Behind interacts with IDEA, and which law covers appropriate areas concerning disciplining students with behavioral issues.
  • Response strategies that are legally appropriate for certain disruptive behaviors, such as unwanted physical and sexual gestures, advances or exhibitions
  • The legal implications of the bullying of special needs students under various federal laws
  • Creation and implementation of a school-wide discipline plan that avoids problems before they occur
