Asserted a claim against a major pharmaceutical company that previously owned our client’s property that under the Transfer Act, the company was responsible for the clean-up of a large quantity of contaminated soil. (In the course of a plant expansion, our client incurred significant expense in excavating and paying to dispose of a large quantity of contaminated soil.) The pharmaceutical firm was in the process of being purchased by a major international pharmaceutical company, and we drafted a court complaint and began intensive settlement negotiations with the larger firm. A Settlement Agreement and new Access Agreement were executed and the claim has been paid.
