Program Summary:

Connecticut Licensed Environmental Professionals ("LEP") are increasingly being called upon to perform tasks by the Connecticut Department of Environmental Protection, the Connecticut Legislature, and their clients that may go well beyond the original objective and statutory authorization contemplated by the Connecticut Transfer Act and the Remediation Standard Regulations. True enough, the original task of investigating and overseeing site remediations in Connecticut is still the main focus and function of an LEP. However, that task has become increasingly complex, and an LEP's professional judgment is subject to DEP audit and evaluation. This seminar will provide an overview of the programs that LEPs are being charged with overseeing and administering, the standards and policies that apply to such to programs and the legal aspects and nuances of implementing them.

After a brief introduction regarding programs affecting LEPs and an overview of the LEP Board and LEP licenses, remediation programs will be evaluated including, an in-depth review of the Connecticut Transfer Act. In addition, the proposed spill reporting regulations, Drycleaning Establishment Fund, and the Underground Storage Tank Reimbursement Program will be reviewed. The program will conclude with an evaluation of LEP's role with creating Covenants Not To Sue and an overview of cases and legal issues associated with the potential claims that might be brought against LEPs in Connecticut.
