Key Dates for Premium Processing of H-1B Petitions and DACA Renewals

Developments and deadlines are happening almost daily, so we want to take a moment to update you on a couple of the most pressing matters regarding immigration.

  • Premium Processing for All H-1B Petitions To Resume on October 3

    USCIS indicated on September 27, 2017 that it was “on track to resume premium processing” for all H-1B petitions on or before October 3.
     
  • USCIS Clarifies Scope of Permissible DACA Renewals

    USCIS has clarified that only those persons whose current DACA expires between September 5, 2017 and March 5, 2018 are eligible to renew their deferred action grant, and then only if the renewal request had been received by USCIS by October 5, 2017. Under the previous DACA guidelines, a person could seek to renew DACA if their deferred action had been expired for less than one year. However, that one-year grace period is no longer in effect, and those with DACA that expired before September 5, 2017 are not eligible to renew.

    Individuals with DACA and associated work authorization that expire after March 5, 2018 are no longer eligible to submit a renewal request. However, their current DACA and work authorization will remain valid until they expire, unless otherwise terminated or revoked.
