The Life, Health, Disability and ERISA Litigation practice at Shipman & Goodwin offers a full range of legal services concerning life, health, disability, pension plan, employee welfare benefit and ERISA litigation in both federal and state courts. Our work includes the representation of insurance companies, health maintenance organizations, administrative service providers, employers and plan fiduciaries in cases involving coverage disputes, breaches of fiduciary duty and statutory and common-law claims arising from both group plans and individual insurance policies. We have used our particular experience in this area, in conjunction with our general litigation and trial skills, to expeditiously resolve claims, whether by motion, negotiation, trial or on appeal.
Shipman & Goodwin lawyers have been instrumental in shaping the development of ERISA preemption caselaw in Connecticut and have litigated numerous ERISA issues. We also have handled a wide variety of claims arising from individual policies and group plans that are not governed by ERISA involving contract interpretation and state common-law doctrines. In addition to coverage matters, we have successfully defended bad faith claims and state statutory claims arising under the Unfair Insurance Practices Acts and Unfair Trade Practices Acts. As well as defending our clients in litigation, we have taken the offensive in commencing declaratory judgment actions with respect to coverage issues.
The firm's Life, Health, Disability and ERISA Litigation practice is equipped with the capacity to handle all matters relating to both ERISA and non-ERISA claims. Moreover, because Shipman & Goodwin is a full-services law firm with experience in related areas including pensions, labor and employment, bankruptcy, health law and business litigation, we are well positioned to draw upon the diverse backgrounds of other lawyers in the firm to provide an interdisciplinary approach to the representation of our clients.
