Successfully Defended Civil Rights Suit Over City's Use of Eminent Domain

City of New Haven, Connecticut

Obtained judgment in favor of the City of New Haven, Connecticut and its Board of Education after a trial in U.S. District Court. The plaintiffs brought civil rights claims under 42 U.S.C. Section 1983 and the Fair Housing Act, claiming that the taking of their residential property by eminent domain for a new school created a disparate impact on the basis of race. The court found for the defendants on all counts. Batiste v. City of New Haven, 239 F.Supp.2d 213 (D. Conn. 2002).
