Sample Hospital Patient Visitation Policy To Comply With New CMS Rules For Participation

The Centers for Medicaid and Medicare Services ("CMS") has issued a final rule revising the Medicare conditions of participation for hospitals and critical access hospitals to ensure that all patients receive equal visitation rights. As of January 18, 2011, Medicare and Medicaid participating hospitals are required to have written policies in place with respect to the visitation rights of patients. As a courtesy to you, Shipman & Goodwin LLP has drafted a sample hospital visitation policy (attached below) which you can use as a model to address the new regulatory requirement for a written visitation policy. In addition, all Medicare and Medicaid participating hospitals should integrate these new requirements into any forms given to patients regarding their patient rights upon admission.
