NLRB Postpones Requirements for Employers to Post Employees' Rights

October 7, 2011

Authors: Brian Clemow, Gary S. Starr

On August 30, 2011 the National Labor Relations Board published in the Federal Register its final rule that would require virtually all private sector employers, whether their employees are represented by a union or not, to post an 11” x 17” poster explaining the rights employees have under the National Labor Relations Act. This requirement was originally scheduled to go into effect on November 14, 2011, but has now been postponed until January 31, 2012. As this rule has come under attack in Congress and is being challenged in court, there may be yet another change in the date for posting, or even a reversal of the posting requirement. We will keep you alerted to further developments.
